Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Eclipse App on mobile or web ("the Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms are a legally binding agreement between you and The Eclipse Company of Earth, LLC ("we," "us," or "our").

If you do not agree to these Terms, do not use the Services. We may update these Terms at any time. Continued use after changes are posted constitutes your acceptance of the revised Terms where permitted by law.

2. Eligibility

You must be at least 13 years of age, or the higher minimum age required in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. License to Use the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes on iOS, Android, and web, subject to these Terms.

You may not:

– Copy, modify, or distribute the Services or their content

– Reverse engineer, decompile, or disassemble any part of the Services

– Use the Services for any unlawful or unauthorized purpose

– Attempt to gain unauthorized access to any part of the Services or their backend systems

4. Accounts

Mobile app: The mobile app does not require or offer user account creation. You use the app without registering.

Website: When you save a viewing spot on theeclipse.app, we may create an anonymous account that you can later link to an email address or sign in with Google or Apple. You may request deletion of website account data by emailing [email protected], as described in our Privacy Policy.

5. Print Purchases

The mobile app may let you create a personalized eclipse print from your session data. The in-app flow may use "reserve" or similar language, but completing checkout is a purchase.

How it works:

  1. You review and consent to upload of session data (such as location and audio signature metadata) needed to produce your print.

  2. We store an order on our servers and open orbitalperspective.store in an in-app browser (or you may complete checkout on the store directly).

  3. You complete payment on orbitalperspective.store. Payment is processed by the store and its payment providers. We do not store your full payment card details.

Print purchases may be subject to additional terms on orbitalperspective.store. In case of conflict regarding checkout or fulfillment on the store, the store's terms may govern that transaction.

Custom goods: Eclipse prints are produced from your personal session data and are typically made to order. Statutory cancellation and return rights may not apply to customized goods under the laws of your country — see EU/UK Consumer Rights below.

6. In-App Purchases

We may offer digital features or subscriptions through in-app purchases in the future. When available:

– Purchases are billed through the Apple App Store or Google Play only

– We do not process payment cards directly

– All purchases are subject to the refund and billing policies of the applicable app store, except as required by applicable law

– Pricing and availability may change; changes will not affect purchases already completed

7. Accuracy of Eclipse Data

The Services provide eclipse timing, path, and visibility data for informational purposes only. While we strive for accuracy, we make no warranties regarding the completeness, accuracy, or timeliness of any eclipse data.

Predictions are based on astronomical calculations and third-party sources. Actual conditions — including weather, atmospheric effects, and geographic variations — may differ.

We are not liable for any loss, inconvenience, or expense arising from reliance on eclipse data, including travel arrangements, equipment purchases, or missed viewing opportunities.

8. Eclipse Viewing Safety

Viewing a solar eclipse without proper eye protection can cause permanent eye damage or blindness. The Eclipse App does not provide, endorse, or certify any eclipse viewing equipment.

Never look directly at the sun without certified eclipse glasses or appropriate solar filters, except during the brief period of totality during a total solar eclipse and only when you can confirm totality has begun.

We are not responsible for any injury, vision loss, or damage resulting from eclipse viewing practices, whether or not you used the Services in connection with your viewing.

9. Intellectual Property

All content within the Services — including text, graphics, maps, data visualizations, logos, and software — is owned by or licensed to The Eclipse Company of Earth, LLC and protected by applicable intellectual property laws.

Map data and tiles are subject to third-party terms (including Mapbox and other providers). You may not reproduce, republish, or commercially exploit content from the Services without our prior written consent.

10. Privacy

Your use of the Services is governed by our Privacy Policy, incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and share information — including strictly necessary cookies on the website, and usage analytics (Google Analytics / Firebase Analytics) only in regions where a cookie consent banner is not required. Analytics is disabled in the EEA, UK, and other regions listed in the Privacy Policy.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or discontinue any part of the Services at any time.

12. EU/UK Consumer Rights

If you are a consumer in the European Union, European Economic Area, or United Kingdom:

– You benefit from mandatory consumer protection laws in your country of residence. Nothing in these Terms limits those rights.

– For distance contracts (including online print purchases), you may have a 14-day right of withdrawal unless an exception applies. Customized or personalized goods made from your eclipse session data may be exempt from the standard withdrawal right once production has begun with your agreement.

– You have statutory warranty rights for goods that do not conform to the contract.

– You may use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE ECLIPSE COMPANY OF EARTH, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $10 USD IF YOU HAVE NOT MADE ANY PURCHASES.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or mandatory consumer rights in the EU/UK.

14. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in York County, South Carolina, except where prohibited by law.

If you are a consumer in the EU/EEA or UK, you benefit from the mandatory provisions of the law of your country of residence. Nothing in these Terms affects those rights, and you may bring proceedings in your local courts where applicable law allows.

15. App Store Terms

If you downloaded the mobile app from the Apple App Store or Google Play, your use is also subject to those platforms' terms. In the event of a conflict between these Terms and the app store terms regarding the store's services, the platform terms govern with respect to those services.

Apple and Google are not parties to these Terms and have no obligation to provide maintenance or support for the app.

16. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice. Upon termination, your license to use the Services ends immediately. Provisions that by their nature should survive termination will remain in effect.

Because the mobile app does not use accounts, termination primarily means loss of access to the Services. Website users may request deletion of account data as described in the Privacy Policy.

17. Changes to These Terms

We may update these Terms from time to time. We will revise the effective date at the top when we do. Please review these Terms periodically. Continued use after changes constitutes acceptance where permitted by law.
